CDEA Pricing

An entity contemplating a secured interest in a property may not have a need to rely on the Innocent Landowner's Defense (ILD). In such cases, trial law has determined that a secured entity may show due diligence as long as an "appropriate level" of inquiry by an"environmental professional" has been executed. The definition of appropriate level of inquiry is left strictly to the discretion of the environmental professional. An environmental professional is defined as:

  1. A registered professional engineer with a specific background either educationally
    or professionally in an appropriate environmental discipline.
  2. Any other college-degreed professional with an environmental education (environmental
    science, industrial hygiene, geology/hydro-geology, biology ecology, chemistry/biochemistry)
    and/or seven (7) years experience in an environmental assessment capacity.

A Consultant's Discretion Environmental Assessment (CDEA) is an instrument that provides the aforementioned level of inquiry and satisfies due diligence requirements in many cases without going to the expense of a Phase I ESA. A CDEA is not a limited scope product. Instead, the consultant will use any information source or depth of inquiry necessary to make a clear decision regarding potential environmental conditions. If, after visiting a site, the consultant surmises that an avenue of inquiry is useful then it will be pursued. Likewise, if a typical avenue of inquiry is unlikely to be useful it is not acted upon.
